A special prosecutor has determined that Joe Biden did, indeed, take and keep classified government papers to which he was not entitled, and even shared the information with others.
Multiple acts violated federal law, but Biden isn’t going to be charged, as least partly because his “age and poor memory would create reasonable doubt for jurors,” according to a report in Just the News.
President Trump, who is being prosecuted for a long list of federal counts for what essentially were the same actions, charged the determination confirms a two-tier system of justice in America, where Democrats commit crimes and get off, while he, as a Republican, is prosecuted.
“Election interference,” Trump charged on social media.
“THIS HAS NOW PROVEN TO BE A TWO-TIERED SYSTEM OF JUSTICE AND UNCONSTITUTIONAL SELECTIVE PROSECUTION!
“The Biden Documents Case is 100 times different and more severe than mine. I did nothing wrong, and I cooperated far more. What Biden did is outrageously criminal – He had 50 years of documents, 50 times more than I had, and ‘WILLFULLY RETAINED’ them. I was covered by the Presidential Records Act, the Secret Service was always around, and GSA delivered the documents. Deranged Jack Smith should drop this Case immediately.”
The FBI, under the direction of Biden, in fact, staged a SWAT-style raid on Trump’s home to hunt down documents he retained from his presidency. As president, he had authority to have those documents and had the authority to declassify them.
Biden’s documents were from his time as senator and vice president, and he did not have the authority to declassify them. Further, he stored them in unsecured locations, like a stack of boxes in his Delaware garage.
Incidentally, Vice President Mike Pence also was found to have had classified materials, and he was not charged either.
The decision on Biden’s case Thursday came from special counsel Robert Hur, who has been investigating for months.
His report was stinging, with his conclusions that Biden “willfully kept classified documents from his time as vice president, shared them with an author and knew he had them as far back as 2017,”Just the News reported.
Still, he recommended against a prosecution, for reasons that included Biden’s declining mental abilities as well as his age.
The report found it “would be difficult to convince a jury that they should convict him — by then a former president well into his eighties — of a serious felony that requires a mental state of willfulness.”
The report, stunningly, found Biden would likely not be qualified to be prosecuted.
“Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory,” Hur found.
He said the evidence, however, was all there.
“Our investigation uncovered evidence that President Biden willfully retained and disclosed classified materials after his vice presidency when he was a private citizen.”
He confirmed materials Biden had hidden from the White House were marked “classified documents about military and foreign policy in Afghanistan and notebooks containing Mr. Biden’s handwritten entries about issues of national security and foreign policy implicating sensitive intelligence source and methods.”
Further, Biden “knew” he had the materials, and he even “shared” them with a ghostwriter.
In stark contrast, special counsel Jack Smith launched a full-scale war against Trump over similar, but not identical, circumstances.
Smith claimed that Trump didn’t cooperate and tried to prevent authorities from recovering his documents.
Partisan Attorney General Merrick Garland had appointed Hur a year ago to investigate Biden’s offenses.
Trump added, “WOW WOW WOW! He’s mishandled classified docs. He SOLD OUT our country every step of the way. And now, his crimes are being SWEPT UNDER THE RUG!
“ALL WHILE THEY’RE COMING AFTER ME ONLY FOR PUTTING AMERICA FIRST!”
